Terms of service
The products sold on https://www.eight-roma.it (hereinafter "Products" and "Website" respectively) are sold by Fashion S.R.L.S., registered office at Via Euripide, 4/6 - 00125 Rome, Italy, registered with the Rome Chamber of Commerce, VAT number 13431121006.

1. ACCEPTANCE OF GENERAL TERMS AND CONDITIONS OF SALE
1.1 EIGHT-ROMA offers Products for sale on the Website exclusively to end consumers — individuals acting without any commercial, craft or professional purpose ("Customer"). EIGHT-ROMA (hereinafter also referred to as the "Seller") therefore reserves the right not to process orders placed by anyone who does not qualify as a "consumer".
1.2 The sale contract between EIGHT-ROMA and the Customer (the "Contract") will become binding upon EIGHT-ROMA's acceptance of the Order, which occurs when the Customer receives EIGHT-ROMA's email confirming the Order (the "Order Confirmation"). If EIGHT-ROMA is unable to accept the Customer's order, the Customer will be informed in writing and no charge will be made for the Product. For further details on order refusals, please refer to clause 2.4.
1.3 By placing an Order (using the order form available on the Website), the Customer declares to have read and understood all information provided during the purchase process, and to fully accept these terms and conditions (hereinafter the "Conditions").
1.4 These Conditions will be included in the Order Confirmation and may in any case be printed or saved on permanent storage devices directly from the Website, in accordance with applicable legislation.
2. HOW TO PURCHASE PRODUCTS
2.1 The Products offered for sale by EIGHT-ROMA are exclusively those displayed on the Website at the time the order is placed, as described in the relevant product information sheet. Product images on the Website are provided for illustrative purposes only. While EIGHT-ROMA makes every effort to display colours accurately, it cannot guarantee that colours will be accurately reproduced on the Customer's device or screen: the product delivered may vary slightly from those images.
The Customer may place an Order by completing and submitting the order form available on the Website in accordance with the instructions provided, after carefully reviewing the product specifications, the relevant price (inclusive of all applicable taxes and charges), and shipping costs (including any additional costs that may be incurred if a faster or non-standard shipping and delivery method is selected). The Customer may also request an invoice for the purchased Product by selecting the relevant checkbox in the order form.
2.2 EIGHT-ROMA will confirm receipt of the Order by sending an Order Confirmation to the email address provided by the Customer. The Order Confirmation will include these Conditions and the summary document on the Right of Withdrawal, together with all information already contained in the order summary displayed prior to purchase (main product characteristics, detailed pricing information, payment conditions, return policy and shipping costs).
2.3 Within the limits of applicable law, EIGHT-ROMA may decline to process purchases where there are insufficient guarantees of solvency regarding the chosen payment method, where orders are incomplete or incorrect, where products are no longer available, or where there are material issues or errors in the presentation or selection of a Product on the Website. The Customer will be informed by email of the cancellation and the reasons for it. If products displayed on the Website become unavailable after the Seller has received the order form, the Customer will be notified as soon as possible. If the order form has been submitted and payment has been made for items that are no longer available, the Seller will refund the amount paid for those items without undue delay, and the sale contract between the parties will be deemed terminated.
3. PRICE AND PAYMENT TERMS
3.1 Prices shown on the Website are inclusive of taxes and VAT where applicable, and where it is possible to calculate these in advance based on applicable tax law. The Customer will be informed in advance of any shipping costs or charges through the Website.
3.2 Payment of Product prices and related shipping and delivery costs must be made using one of the methods indicated in the order form, such as credit or debit card, PayPal, or any other specific payment method available on the Website. In no case will charges exceed the costs actually incurred by the Seller in relation to the previously selected payment method.
3.3 In the case of credit/debit card payment, all details (such as card number or expiry date) will be automatically transmitted via encrypted protocol to the bank providing remote electronic payment services, without EIGHT-ROMA having access to such data. This data will not be used by the Seller except to execute the purchase procedure or to issue refunds in the event of a return in accordance with the exercise of the right of return, or to report fraud to law enforcement.
3.4 At no stage of the payment process will the Customer's electronic payment method details be communicated to EIGHT-ROMA by the bank, as such data will be sent directly and securely to the website of the financial institution responsible for the transaction. Since none of this data will be stored in EIGHT-ROMA's systems, EIGHT-ROMA will not be liable for any fraudulent or unlawful use by third parties of the Customer's payment method during the payment process, except to the extent that such misuse is attributable to the negligence, fraud or unlawful conduct of EIGHT-ROMA.
3.5 The price of the Products and related shipping and delivery costs, as indicated in the order form, will be charged to the Customer's account only after the order has been confirmed.
4. PRODUCT DELIVERY AND RELATED COSTS
4.1 The Product will be the Customer's responsibility from the moment EIGHT-ROMA, through its service providers, delivers the Product to the address indicated by the Customer in the Order. The Customer will acquire ownership of the Product once EIGHT-ROMA has received payment in full.
4.2 Products will be delivered to the Customer at the cost specifically indicated on the Website prior to the Order being placed and shown in the Order summary. In such cases, the amount paid by the Customer will be refunded within 15 days of the last delivery attempt.
4.3 To receive delivery of the Products, the Customer must sign the relevant delivery documentation after verifying that: (i) the number of items delivered matches the number indicated on the delivery note, and (ii) the packaging is intact, undamaged, dry and in any case unaltered, including the sealing materials (adhesive tape or metal seal).
4.4 Any damage found to the packaging and/or the Product and any discrepancies in the number of items or information contained in the delivery note must be reported immediately on the delivery note to be returned to the courier.
4.5 Any issues relating to the integrity of the Products received or any damage, missing items or incomplete delivery (which cannot be identified or reported at the time of delivery) must be reported within 7 (seven) days of delivery, in order to allow EIGHT-ROMA to carry out the necessary checks. Please note that this reporting period does not affect the Customer's statutory warranty rights or right of withdrawal.
4.6 All products are fitted with an identification tag attached to a single-use seal. The Customer must not remove the tag or seal from purchased Products if they intend to return them.
4.7 Shipping costs and delivery times depend on the type of shipping selected by the Customer during the purchase process and indicated in the order form. Depending on the shipping method chosen, the Seller will confirm to the Customer that the Order has been dispatched (the "Dispatch Confirmation").
4.8 Delivery times indicated on the Website are purely indicative. After receiving the Dispatch Confirmation, the Customer may monitor the status of the shipment from the "My Account" section of the Website and/or via the tracking code provided in the Dispatch Confirmation.
4.9 Orders will only be shipped to a postal address. Please note that we may not be able to deliver to all valid addresses and, in such circumstances, we reserve the right, at our sole and absolute discretion, to cancel the Order. If we are unable to ship to the delivery address provided, we will notify the Customer, the Order will be cancelled, and the Customer will receive a refund (unless they are able to provide a suitable alternative delivery address).
5. RIGHT OF WITHDRAWAL AND RETURNS
5.1 In addition to any rights and protections available to the Customer under applicable law, the Customer has the right to withdraw from the Contract without reason, without penalty and without providing any explanation, within 14 (fourteen) days of the date of delivery of the Products.
5.2 The Customer may exercise the right of withdrawal (cooling-off period) referred to in Art. 5.1 above by completing the relevant EIGHT-ROMA online return form. EIGHT-ROMA will confirm receipt of the return form by sending an email to the address provided by the Customer.
5.3 In the event of withdrawal, the Customer must return the Products to EIGHT-ROMA within 14 (fourteen) days (and no later) from the date on which the above notice was sent, choosing one of the following options:
5.3.1 Sending the Products to the address expressly indicated in the return form using the courier designated by EIGHT-ROMA in the return form. Products may be shipped using the order details indicated in the order confirmation. In this case, return shipping costs are borne exclusively by the Customer.
5.3.2 Sending the Products to the address expressly indicated in the return form using any courier of the Customer's choice (in which case return shipping costs will be borne solely by the Customer).
5.3.3 Returning the Products in person to the boutique expressly indicated in the return form (the Customer will be required to present the Products together with the return form and a valid identity document).
5.3.4 If the Customer collected the Products in person via the in-store collection service, the Products may also be returned to the same boutique.
5.4 The Product must be returned together with its original packaging (including packaging materials and any documents, accessories, labels, identification tags, seals, dust bags, etc.) and must be kept with care and used only for the time strictly necessary to assess its nature, specifications and dimensions. It must show no signs of wear or soiling (or any other alteration) (except as necessary to establish the nature, characteristics and functioning of the goods), as outlined below:
The right of withdrawal may only be exercised in relation to the entire Product purchased; partial withdrawals (accessories, add-ons, etc.) are not permitted.
Within the limits of applicable law, the transport of the Products — until the Customer receives confirmation that the Product has been correctly returned and delivered to EIGHT-ROMA — will be the sole responsibility of the Customer in the cases set out in points 5.3.2, 5.3.3 and 5.3.4. Accordingly, if the Product is damaged in transit, EIGHT-ROMA must inform the Customer so that they may promptly file a claim with the courier and request a refund; the Product will be made available to the Customer and the notice of withdrawal will be cancelled.
EIGHT-ROMA accepts no liability for Products damaged, stolen or lost in transit, or in any case in connection with their shipment, where the return shipment to EIGHT-ROMA is handled in accordance with the methods set out in points 5.3.2, 5.3.3 and 5.3.4.
5.5 EIGHT-ROMA will refund the Customer the full amount already paid within 14 (fourteen) days of the date of withdrawal. EIGHT-ROMA may withhold the refund until the returned Product is correctly received by EIGHT-ROMA or until the Customer provides proof of correct return, whichever occurs first.
5.6 Unless otherwise agreed between the parties, the amount originally charged to the Customer will be refunded using the same payment method used in the original purchase transaction. In the case of cash on delivery, the amount originally paid will be refunded by bank transfer using the banking details provided by the Customer in the return form. In all cases, no costs will be charged to the Customer in connection with the refund.
5.7 Upon receipt of the Products, EIGHT-ROMA will inspect them and, in the event of non-compliance with the above, will inform the Customer by email that the value of the returned Products has been reduced due to the Customer's failure to comply with the above Conditions. In the same email, EIGHT-ROMA will also communicate the amount to be deducted from the refund, unless the Customer chooses, at their own expense, to have the Products returned to them in the same condition in which they were returned to EIGHT-ROMA.
5.8 If the right of withdrawal is voided (for example, if the Product is returned damaged), EIGHT-ROMA will return the Product to the Customer. In this case, the Customer will be charged the relevant shipping costs and, if already refunded, the price of the Product.
5.9 The right of withdrawal does not apply to Products purchased on sale or during promotional events or other promotional periods.

6. WARRANTIES
6.1 All Products sold by EIGHT-ROMA are covered by the statutory conformity warranty as provided for under applicable law. In accordance with applicable legislation, the Customer must retain the proof of payment together with the delivery note in order to make use of the warranty.
6.2 The conformity warranty will only apply if the Product has been used correctly, in accordance with its intended purpose and in compliance with the care and washing instructions contained in and/or provided with the Product.
6.3 Without prejudice to the provisions of Art. 2.1 above, EIGHT-ROMA will deliver to the Customer Products that conform to the Contract. In the event of defective Products and/or Products not conforming to the stated qualities, the Customer is entitled to the remedies provided under applicable law (including, where applicable, free repair or replacement of the Product, or a reduction in the price paid for the defective Product).
7. PRIVACY
7.1 Where EIGHT-ROMA collects personal data from the Customer when an Order is placed, such personal data will be processed by EIGHT-ROMA for the purpose of completing the Order and in accordance with applicable data protection laws and EIGHT-ROMA's Privacy Policy (hyperlink).
8. APPLICABLE LAW AND JURISDICTION
8.1 To the extent permitted by applicable law, the Contract and its provisions are governed by the law applicable to the Consumer. Any dispute arising from or in connection with the Contract will be submitted to the competent court of the Customer's place of residence.
8.2 Customers resident in a European Union member state may refer to the platform established by the European Commission for the resolution of disputes relating to distance sale contracts ("ODR Platform"). Through the ODR Platform, the Customer and the Seller may resolve disputes relating to purchases made under these Conditions with the assistance of an impartial body. 10. UPDATES
10.1 These Conditions may be amended at any time and for any reason. The new Conditions will take effect from the date of publication on the Website for sales made from that date onwards, and accordingly each Contract will be governed by the Conditions in force at the time of its conclusion.
11. LANGUAGE
11.1 These Conditions are written and shall be interpreted in the Italian language. Should the Conditions be translated into other languages, the Italian version shall prevail for all purposes, including any disputes or claims that may be resolved through any legal proceedings.
11.2 All communications between the parties arising from or in connection with these Conditions shall be in the Italian language.
